Information for microenterprises in liquidation

When can assets start to be published in PLABI?

Once the order opening the special procedure is received, the debtor, their legal/procedural representatives or the appointed insolvency administrator may, after authentication, access the private area of PLABI to view and complete the mandatory fields of the assets previously included in the forms of the Electronic Microenterprise Service (Form 2: Application for opening by debtor (TRLC art. 691. 1 and 3) or Form 4: Acceptance of application and opening by the debtor (TRLC art. 691 quinquies. 1. 1º)), grouped in lots, for their automatic publication.

I am the responsible party, legal/procedural representative or insolvency administrator of a microenterprise in liquidation. How can I access the private area of PLABI?

You can only access the private area of PLABI if your NIF or CIF is associated with the debtor party of a special liquidation procedure as a microenterprise or its representative, as well as a legal/procedural representative (Lawyer / Solicitor) or insolvency administrator appointed in the procedure.

The association is made in the forms available in the Electronic Microenterprise Service.

In the private area you will find the assets of all the procedures to which you have been associated.

The identification methods available in PLABI are:

Any of the authentication methods accepted in Cl@ve:

  • Electronic DNI.
  • Digital Certificate.
What functionalities for microenterprises in liquidation does PLABI have?

Profiles associated with the debtor party of a special liquidation procedure may:

  • Create announcements for assets in liquidation, grouped in lots.
  • Save a draft lot announcement.
  • Modify lot announcements.
  • Consult information about their judicial procedure.
  • Add assets to their judicial procedure.
  • Attach the Liquidation Plan documents to the Platform.
  • Respond to queries raised about their lots.

How do I publish my assets?

Please note that, for the publication and management of assets in liquidation, only the debtor or liquidator party of a special liquidation procedure, their representatives or the insolvency administrator appointed in the procedure will have this option in PLABI.

Therefore, only these participants can complete the mandatory fields of the announcement of assets grouped in lots. Once these fields are completed, the lot will be published automatically on the next Monday at 11:00 am. If the information is completed on Monday after the publication time, it will be published automatically on Wednesday at 11:00 am. Once published, the announcement will appear in the public area.

How can I unpublish an announcement?

To unpublish your announcement, you must open a ticket at the User Support Centre (CAU) (https://cauexterno.justicia.es/webtier-9.62/ess.do) requesting unpublishing.

For this, you must provide:

  • Identifying data of the person requesting unpublishing:
    • Full name.
    • NIF.
    • Bar number and bar association where applicable.
  • Identifying data of the procedure:
    • Procedure number.
    • Judicial body in charge of the procedure.
    • LC identifier of the initial procedure form from the Electronic Microenterprise Service.
  • Identifying data of the lot:
    • Lot title.
    • Lot ID.
    • Title of the assets composing the lot.
Why can't I see my procedure in the Electronic Platform for Asset Liquidation?

If you have started any of the initial procedure forms in the Electronic Microenterprise Service (SEM) or have recently been assigned a number to the judicial procedure, do not worry if you do not yet see it reflected in PLABI as, for it to be visible on this Platform, the judicial body in charge must act on the procedure, which may involve a waiting time.

If after a considerable period you still do not see your procedure, to review your case you can contact User Support Centre (CAU) [https://cauexterno.justicia.es/webtier-9.62/ess.do] indicating:

  • Name, surnames and NIF.
  • If you are legal or procedural counsel for the procedure, bar number and bar association.

To identify the associated procedure, you must indicate its number and the judicial body in charge, also providing the LC identifier of the initial procedure form from SEM.

What happens if an insolvency administrator has been appointed in the special liquidation procedure?

In this case, the insolvency administrator will be the only profile able to create lot announcements, request unpublishing at the User Support Centre (CAU) or modify the information of the assets of the judicial procedure in which they have been assigned by the judicial body and have also been reflected by the same judicial body in the Electronic Microenterprise Service (SEM), as well as include new assets in the judicial procedure. The rest of the profiles (debtor, legal, procedural representative) will only be able to view the published and unpublished announcements of assets in liquidation, as well as the information available in their private area.

If you are an Insolvency Administrator and have been appointed in the procedure, but have not been reflected in SEM, you should contact the judicial body so that they can do so and you can access the assets in PLABI.

What communications will I receive in my Communications section?

From the Communications section in your private area, you will be able to view all communications and notices issued by the Platform relating to your judicial procedure and announcements. The information displayed will be the title and body of the communication, as well as the date and time of receipt. The Communications you will receive will relate to:

  • Registration or modification in your judicial procedure.
  • Publication of your announcements.
  • Unpublishing of your announcements.
  • Creation of a new query in the announcement.
  • A query is answered.
  • An announcement is marked or unmarked as favourite.
How can I respond to a query?

It should be noted that only participants in the procedure – microenterprise, their lawyer, solicitor, or, where appropriate, the insolvency administrator – who have their permissions enabled in the judicial procedure will be able to respond to queries. To respond to a query related to your lot, you must log in to the Platform.

Once logged in, you can respond by accessing the queries from the detail of your published lot in the public area or from the Active queries section in your private area.

Remember that each query allows a maximum of 5 responses.

What should I do if I cannot access the private area for asset publication?

Please note that, for the creation of announcements and management of assets in liquidation, only the debtor party of a special liquidation procedure, their representatives or the insolvency administrator appointed in the procedure will have this option in PLABI.

Therefore, you will only be able to access the announcements and judicial procedure section of the private area of PLABI if you are a user belonging to the debtor or liquidator party of the associated special judicial liquidation procedure. The information available in PLABI is that incorporated in the initial forms of the liquidation procedure and will be available once the order opening the procedure is received.

If you do not act as any of the figures indicated above in a special judicial liquidation procedure, you will not see assets or procedures in your private area.

If, on the other hand, you have a judicial procedure and cannot see your assets or the procedure on the Platform, you can contact the Service Manager (CAU justicia.es): (https://cauexterno.justicia.es/webtier-9.62/ess.do) indicating your NIF or CIF number, the role you hold (microenterprise, lawyer, etc.) and the number of the special judicial liquidation procedure, as well as the Court to which you belong so that the incident can be reviewed as soon as possible. If you are the legal/procedural representative or the insolvency administrator, we need to know the bar number and the bar association.
